Should I Display the Cookie Banner with all Tags and Cookies Active or Inactive?
Displaying the Cookie Banner with all Tags activated is not a recommended practice. However, we do offer a feature that allows this configuration, which is available to all users. This is a decision that is entirely in the hands of our customers and users when configuring their Cookie.
There are various interpretations regarding the acceptance of this "pre-setting" under different legislations worldwide, such as the GDPR, LGPD and many others. After multiple discussions in the field regarding principles, case law, and Privacy by Design, things became clearer with the publication of the Guidance Document (in Brazilian Portuguese) by the ANPD - data protection agency from Brazil.
For LGPD (brazilian data protection law) compliance, the ANPD, in its Guidance Document, does not recommend “Presenting non-essential cookies as enabled by default, requiring manual deactivation by the user”. See page 33, section “What to avoid when designing cookie banners.”
However, if you wish to implement this setting in your Cookie Banner, follow the step-by-step guide below.
How to Display the Cookie Notice with All Tags and Cookies Active or Inactive?
Log in to your AdOpt account.
Choose the (1) Organization where the Cookie Banner you want to configure is located.
Select the (2) Disclaimer in which Cookie Tags will be activated or deactivated.
Go to the (3) Settings for your Disclaimer.
Toggle the (4) Tags and scripts inactive by default button to enable or disable the default configuration of the Cookie Banners. This way, all "non-essential" tags will be enabled or disabled in your Cookie Banner.
Click (5) Save to store the changes made so far.
Done! The Tags in your Cookie Banner will now reflect your new selection.
