What Are the Purpose Categories for Tags According to the LGPD - brazilian data protection law?
There are 5 Purpose Categories for Tags that you need to comply for your Tags and website to operate within the law in Brazil:
Necessary: Without them, your business model doesn't work, or you are required to use them by law/your local legislation.
Marketing / Advertising: These are used to launch remarketing campaigns, populate ad pixels, email cadences, etc.
Statistics / Analytics: These allow you to analyze what visitors do, where they come from, and how they behave on your website.
Performance: Tags that maintain website functionalities ensuring it runs properly, e.g., prevent DDoS attacks.
Functional: Tags that handle functionality aspects, such as remembering preferences or recognizing logged-in sessions, chatbots.
ℹ️ Info: Tag categorization is a step that involves the intention (Purpose) of using Cookies, your company's strategy, as well as the LGPD - brazilian data protection law and its interpretations. Talk to a lawyer or your company's Data Protection Officer (DPO) to define the categorizations you consider appropriate.
AdOpt’s Tag Scanner automatically categorizes the Tags found on the Disclaimer’s linked URL(s) into the 5 previously described Categories. However, if a Tag is not recognized by the scan, it will be placed into a sixth Category: Unknown.
📢 Important: Attention! To properly comply with the law, all Tags categorized as Unknown in AdOpt’s panel must be re-categorized into one of the 5 Categories prescribed by the LGPD - brazilian data protection law.
How to Categorize Tags in the AdOpt Panel?
Follow the step-by-step at the beginning of this tutorial (How to Find Tags in the AdOpt Panel?) until the final step.
Once the list of Tags is found, locate the (1) Classification menu.
⚠️ Tip: Make sure the scan is updated with the current version of your site, because if new Tags were added to your site after the last scan, they will not be on the list and, therefore, won’t be categorized. If your site only has AdOpt Tags, you can classify them as Necessary. After all, the LGPD - brazilian data protection law requires us to have a consent management tool and/or equivalent on our sites when collecting contact data and/or using tracking pixels. Therefore, it is necessary for your site’s functionality and business model to comply with the LGPD - brazilian data protection law.
3. Review the automatic categorization of each Tag. If necessary, Select the new category for each Tag found.
4. Scroll to the bottom of the Tag List page and click Save and publish to save your changes.
5. Done! Once all Tags are categorized, the Tag Scanner section of the Disclaimer will turn green.
ℹ️ Info: In case of a new third-party Tag, AdOpt must be re-configured because the “rules of the game have changed.” This is neither good nor bad, it is simply a new variable/combination of trackers that your visitor has the right to understand and consent to — or not. Therefore, all consents prior to this change will differ from the new combination of tags. As a result, visitors returning to your site after this change will be notified again by AdOpt to provide consent for this newly added combination.
