Privacy Policy and Terms of Use Changes
Below are the main details regarding the update of AdOpt’s documents.
The Privacy Policy remains unchanged, with its latest update dated April 2, 2024.
The Terms of Use of the AdOpt Platform were updated on July 22, 2026, and include changes and new details related to contracting, use of the platform, plans, intellectual property, processing of personal data, responsibilities, and other conditions applicable to Users.
Privacy Policy
Privacy Policy Has Not Been Changed
The current version of the Privacy Policy remains unchanged, with its latest update dated April 2, 2024.
The document remains available for consultation and provides information on how AdOpt collects, uses, stores, and protects personal data, as well as information regarding cookies, data sharing, international transfers, and data subjects’ rights.
Terms of Use
Update to the Terms of Use
The Terms of Use of the AdOpt Platform were updated on July 22, 2026.
The new version includes important changes and additional details regarding the rules applicable to the use of the AdOpt Platform and the contractual relationship between AdOpt and its Users.
Purpose and Use of the Platform
The Terms now provide a detailed description of the AdOpt Platform as a consent and privacy management solution (Consent Management Platform – CMP), made available as Software as a Service (SaaS).
The Terms also define the concept of User and the main ways in which the platform may be used, including managing data subjects’ preferences, recording consent expressions, and configuring access levels.
Plan Features and Pricing
AdOpt Platform services are provided according to the features and prices of the plans made available by AdOpt.
The Terms establish that AdOpt may change plan features, conditions, and prices, provided that at least 30 days’ prior notice is given. The User is entitled to terminate the agreement without charge if they do not wish to remain bound by the new conditions.
Contracting and Free Trial
The new version provides more details regarding the conditions for contracting the services, including registration, plan selection, and acceptance of the Terms of Use and Privacy Policy.
Specific conditions have also been established for the Free Trial applicable to new registrations made as of July 22, 2026. The trial period may last up to 30 days, with no payment information required during the initial registration, and includes a version of the Platform with limited functionality.
Contract Term and Cancellation
The subscription is automatically renewed according to the billing frequency of the selected plan.
The User may request termination of the subscription in writing, by email, or directly through the platform. Access to and provision of the services will remain available until the last day of the subscription period.
Price Adjustments, Payments, and Non-Payment
The updated Terms establish that plan prices may be adjusted.
Increases resulting from annual inflation adjustments are limited to 7%, will be communicated in writing, and will take effect on the subscription renewal date. Higher increases may occur when negotiated and agreed upon by the parties.
In the event of non-payment, a 2% penalty on the amount due will also apply, in addition to 1% monthly interest.
Service Interruption
AdOpt may suspend the services in certain circumstances, including non-payment exceeding 10 days, violation of the Terms of Use or Privacy Policy, use of the platform for purposes contrary to applicable law, or other circumstances provided for in the document.
The Terms also establish a minimum Platform availability SLA of 99% during the term of the contractual relationship, subject to the 1% exception provided for in the agreement itself.
Confidentiality, Licenses, and Intellectual Property
The new Terms provide additional details regarding AdOpt’s rights over the Platform and its intellectual property.
The license granted to the User is worldwide, non-exclusive, and conditional upon maintaining the subscription, without transferring ownership of the Platform.
The Terms also establish the possibility of using anonymized data to create metrics, improve services, develop products, and perform product diagnostics and corrections.
Use of the User’s Name, Logo, and References
The updated Terms establish that AdOpt may use the User’s name and logo on its website to identify the User as a Platform user.
AdOpt may also publicly refer to the User in promotional materials, communications, events, or case studies. The User may contact AdOpt if they have any reservations regarding this authorization.
White-Label Platforms
The new version also provides further details regarding White-label solutions.
The acquisition and use of White-label products, solutions, or services, as well as the exchange of data with White-label applications, are the User’s responsibility, subject to the conditions established in the Terms.
When a White-label application is used together with the AdOpt Platform, the respective provider may access the data necessary for the integration, in accordance with the applicable conditions.
Processing of Personal Data
The updated Terms provide more detailed rules regarding the processing of personal data.
With respect to the User’s personal data and the personal data of individuals within the User’s organization, AdOpt will process such data strictly as necessary to fulfill its contractual obligations, in accordance with its Privacy Policy.
With respect to third-party data, such as visitors to Users’ websites, the Terms clarify that AdOpt does not collect or process such data, except in expressly provided situations, such as when a data subject directly contacts AdOpt to exercise rights relating to their data or to withdraw consent.
Subprocessors and Security
The Terms also provide further details regarding the use of specialized third parties as Subprocessors.
AdOpt requires these providers to undertake security commitments consistent with those established in the Terms before any transfer or further processing of personal data takes place.
Periodic compliance checks are also provided for, in addition to AdOpt’s responsibility for the acts of its Subprocessors in connection with the processing of personal data.
Security Incidents and Notifications
The new version establishes specific procedures for situations involving personal data incidents.
In the event of an actual or suspected breach, or a potential threat to the protection and security of personal data, AdOpt must notify the User within 36 business hours of becoming aware of the occurrence, providing the information specified in the Terms.
The same 36-business-hour period applies to certain communications relating to court orders or official requests involving personal information, where providing such notification is legally permitted.
AdOpt’s Rights
The Terms reinforce AdOpt’s rights relating to its Platform, intellectual property, and the use of feedback provided by Users.
The Terms also provide for the use of the User’s name and logo to identify the User as a Platform customer, subject to the conditions established in the document.
Changes to the Terms of Use
AdOpt may amend the Terms of Use, including provisions relating to plans, features, and prices.
Changes must be communicated to the User at least 30 days in advance of their effective date.
Effective Date of the New Version
The current version of the Terms of Use became effective:
July 22, 2026, for Users whose registrations were submitted on or after that date;
August 22, 2026, for Users who already had an active agreement as of July 21, 2026, subject to the 30-day period following publication of the new version.
