HERO is a regulated financial institution, which requires us to report to the relevant authorities if clients are U.S. tax residents or residents of countries other than France. Rest assured, this is merely an administrative formality.
Are you a U.S. citizen or tax resident? Is your company subject to U.S. taxes?
If so, please complete the form by providing your U.S. Tax Identification Number (TIN) or that of your company. This number is typically used for administrative and tax purposes:
For individuals: this is the Social Security Number (SSN) or Employer Identification Number (EIN).
For businesses: this number is listed on your tax return.
Respond promptly to avoid any issues. If you are a U.S. tax resident and do not respond, a flat 30% withholding may apply to certain U.S. income as per their regulations.
Is your company or yourself a tax resident of a country other than France or the United States?
If so, complete the form by providing your Tax Identification Number (TIN) or that of your company, which can also be found on your tax return. For more information, click here.
Note: Not all countries issue Tax Identification Numbers. In such cases, simply provide the name of your tax residence country or that of your company.
Is your company a Passive Non-Financial Entity (PNFE)?
If your tax residence or that of your company is in the U.S. or a country other than France, you need to inform us if your company qualifies as a PNFE.
What is a PNFE?
A PNFE is an entity where more than 50% of its income is considered "passive" (e.g., dividends, rents, interest, capital gains) or more than 50% of its assets generate passive income. Examples include family real estate companies (SCI), asset management firms, or investment funds.
Is there a beneficial owner within the PNFE who is a U.S. tax resident or a resident of a country other than France?
If yes, provide their name, first name, date and place of birth, as well as their Tax Identification Number.
☝️ Reminder: A beneficial owner is an individual who owns more than 25% of the capital, voting rights, or control over a company.
