How Happy Birthday collects, uses, and shares personal information.

Happy Birthday is operated under licence by Union Works Ltd. We're committed to protecting and respecting your privacy and we adhere to GDPR.

This Privacy Policy sets out how we collect, use, and share information that identifies you or is associated with you ("personal information"). Please read it carefully to understand our practices regarding your personal information and how we treat it.

By installing the Happy Birthday app, you consent to the use of your personal information as described in this Privacy Policy.

For the purposes of the Data Protection Act 1998 and GDPR, the data controller is Union Works Ltd. Our registered office is at 86–90 Paul Street, London, EC2A 4NE. Our company registration number is 10900591.

Overview of the app

Happy Birthday ("the App") provides an end-to-end birthday email campaign service ("the Service") to merchants who use Shopify to power their stores. The App collects the birthdates of your customers and sends them a birthday email including a discount on or before their birthday.

This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

Personal information the app collects

Merchant data

When you install the App, we automatically access and store the following information from your Shopify store and the associated main contact account:

  • Shopify store URL (both the .myshopify.com URL and your custom URL if set)

  • First name

  • Last name

  • Store timezone

  • Store currency setting

  • Store Shopify plan

  • Store admin email address

Customer protected data

We collect the following types of personal information from your customers when they join your Birthday Club:

  • Shopify Customer ID

  • First name

  • Last name

  • Email address

  • Mobile phone number

  • Date of birth

  • Discount code used

  • Order total

  • Order subtotal

  • Discount amount

We don't collect any other personal information directly or indirectly from your customers.

How customer data reaches us

Most customer data is submitted via one of the Birthday Club sign-up surfaces on your store, the Happy Birthday app block, the Birthday Sign-up Page, or Shopify POS.

It can also be added by you directly, by importing a list of customers, or adding members manually one at a time inside the app.

We also have integrations with third-party service providers that, when enabled, send us customer data so the customer can join your Birthday Club. These integrations are:

  • Mailchimp

  • Klaviyo

  • Omnisend

  • Brevo

  • Privy

  • Customer Fields

  • Recharge

  • SMSBump (Yotpo)

Shopify script tags

We previously installed Shopify script tags into your storefront to determine when to show the Happy Birthday Sign-up Form on your post-purchase pages. Since Shopify moved their checkout to use app block compatible post-purchase pages, we no longer install or update the post-purchase page script tags.

The Happy Birthday app is available as a checkout app block which can be added by merchants to their Thank you page and Order status page.

Processing the personal data

We process customer personal data only for the purpose of delivering the Service. We require the following Shopify scopes:

  • Read and write orders - to find out when a birthday discount code has been used (so we can report on conversions). We can also tag an order with the customer's birthdate.

  • Read and write customers - to find out if a Birthday Club member is also a customer in your Shopify store. We can also tag a Shopify customer record with the customer's birthdate.

Webhooks

We listen to the orders/created webhook so that, when an order is placed, we can check whether one of our birthday discounts was used. If it was, we store details about the order amount and the value of the discount.

How do we use a merchant's personal information?

  • To communicate with you about the Service - improvements, optimisation, new features

  • To let you know when a plan upgrade is required to maintain the Service

  • To occasionally tell you about other Union Works products or services

How do we use your customers' personal information?

We use the personal information we collect from your customers to send them a birthday email once per calendar year, and to provide you with a campaign overview within the Happy Birthday app.

Sharing your customers' personal information

Some customer personal data is shared with third-party service providers (sub-processors). The full list:

  • Mailgun Technologies, Inc. - transactional email delivery. We provide them with the email address of any customer to whom we send a birthday email.

  • Amazon Web Services, Inc. (AWS) - cloud hosting, database, queues, and S3 storage. The Happy Birthday database contains your store's settings and tables of customer details.

  • Mantle - billing and subscription management. Mantle receives your store's billing and usage data so we can manage your subscription correctly.

  • Yotpo (SMSBump) - when the SMSBump integration is enabled, we share opted-in members' mobile numbers and SMS message content with Yotpo for delivery.

  • Google LLC (Google Workspace) - email and Google Drive. Email we receive (e.g. via support) passes through Google Mail and is stored there.

  • Understand.io - application logging and error tracking.

  • GitLab, Inc. - source code hosting. No customer or merchant personal data is stored here - internal use only.

App integrations

If you enable any of the following integrations, we may send customer data into that service:

  • Mailchimp

  • Klaviyo

  • Omnisend

  • Privy

  • Customer Fields

  • Brevo

  • Recharge

  • Yotpo (SMSBump)

Cookies

We don't use cookies to track your customers' activity on your store.

Change of business ownership

Personal information may be shared with a company that acquires our business - whether through merger, acquisition, bankruptcy, dissolution, reorganisation, or similar transaction. If this happens, we'll post a notice on our home page.

Legal requests

We may share your personal information to comply with applicable laws and regulations, to respond to a subpoena or other lawful request, or to otherwise protect our rights.

Your rights

If you're a European resident, you have the right to access personal information we hold about you and to ask that it be corrected, updated, or deleted. To exercise this right, contact us using the details at the bottom of this article.

We process your information to fulfil contracts we have with you (e.g. if you make a purchase), or to pursue our legitimate business interests as listed above. Please note that your information may be transferred outside Europe - including to Canada and the United States - as part of normal operation of the Service.

Data retention

We only retain personal data for as long as necessary to fulfil the purposes we collected it for, including for satisfying any legal, accounting, or reporting requirements. When deciding the right retention period, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorised use or disclosure, the processing purposes, whether those can be achieved by other means, and applicable legal requirements.

For tax purposes, we keep basic information about our customers (Contact, Identity, Financial, and Transaction Data) for six years after they stop being customers.

Changes

We may update this privacy policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons.
