New service providers that do not contain any data will be reported as "third country transfer" by default in the .pdf export of the processing activities.

The software wants to play it safe here and not throw out any incorrect non-third country transfers. Please use the "External data transfer" area to enter the relevant data for your recipient and then release it.

When is a recipient not displayed as a potential third country transfer?

The following criteria must be met:

Data processing:

  • "Place of data processing" = within the EU or in a third country with an adequacy decision

  • "Yes" - Is data processing outside the EU or a third country with an adequacy decision excluded?

  • "Yes" - Is it contractually ensured that all of the provider's services (e.g. support) are provided within the EU or a third country with an adequacy decision?

Other processors (subcontractors)

  • "Yes" - Is data processing outside the EU by another processor (subcontractor) excluded?
